PETALING JAYA: Fake Shell lubricants worth over RM100,000 were seized from a godown in a raid by the Domestic Trade and Consumer Affairs Ministry.
Enforcement director Datuk Iskandar Halim Sulaiman (pic) said two local men, aged 34 and 53 who were at the location in Taman Industri, Subang Jaya, were arrested and will be remanded.
Iskandar said the raid was conducted following complaints from Shell, the registered trademark owner.
“Based on checks conducted by the Ministry’s enforcement officers along with representatives from the registered trademark owner Shell, we found various lubricants such as transformer oil, compressor oil, truck and heavy duty engine oil, grease and slideway oil for the use of heavy vehicles," he said.
Iskandar added that the total volume of the items seized is estimated to be about
10,040 litres and said that a set of computers connected to a printer at the site are suspected to have been used to produce the registered trademark.
“Labels and bottle caps with the Shell logo were also found. All of these items and relevant documents were seized for further investigations. All of the seized items were estimated to have been worth RM111,300,” he said in a statement on Wednesday (Sept 16).
Iskandar said according to the godown premises manager, the lubricants from a 200-litre barrel would be transferred into smaller 20-litre barrels to be sold around the Klang Valley at prices ranging between RM185 and RM240.
The case is being investigated under Section 101(b) Trademarks Act 2019, and if convicted, offenders stand to be fined not more than RM1mil, jailed not more than five years or both upon sentencing.
The case will also be investigated under Section 5(a) of the Trade Descriptions Act 2011 and if convicted, offenders can be fined not more than RM250,000 for the first offence or not more than RM500,000 for the second or subsequent offences.
