KUALA LUMPUR: Former education minister Datuk Mahdzir Khalid (pic) identified the two voices in the viral recording which was released by the Malaysian Anti Corruption Commission (MACC) in January.
He testified the voices were of former prime minister Datuk Seri Najib Razak and his wife Datin Seri Rosmah Mansor, the court heard today (Feb 10).
A snippet of the clip, containing the infamous "can I advise you something" quote was played by the prosecution to Mahdzir during the examination-in-chief by Datuk Seri Gopal Sri Ram.
Sri Ram: If I were to play a recording, would you be able to identify his (Najib's) voice?
Mahdzir: Recording? Yes.
Sri Ram: What about the accused Rosmah, are you familiar with her voice?
Mahdzir: Familiar, just that I seldom meet her.
Sri Ram: Can you identify her voice?
The prosecution then played the audio clip, of which the male and female voices in the clip were identified by Mahdzir as being that of Najib and Rosmah.
Earlier, the defense objected to the playing of the audio clip.
Datuk Jagjit Singh said that the recording has not been tendered as evidence to the court.
"We don't have transcript and we don't know what will come out. We should at least have a transcript of the recording first," said Jagjit.
However, Sri Ram said that the recording would only be played only for the witness to identify the voices in the recording.
Jagjit then argued that the playing of the recording would be prejudicial to the accused.
"If you play it now; it will be published by the press," he said.
High Court Judge Justice Mohamed Zaini Mazlan however interjected.
"Fortunately this is a trial by court, not trial by press," he said.
Justice Zaini then allowed the recording to be played.
