Fisherman gets 202 years for raping stepdaughter, but will serve only 38

IPOH: The Sessions Court here sentenced a 36-year-old fisherman to 202 years in jail and 23 strokes of the rotan for raping, molesting and having unnatural sex with his underaged stepdaughter from April 2016.

However, he will only serve 38 years as the judge ordered the majority of the sentences to run concurrently for the 22 charges.

On Oct 11, the man had pleaded guilty to six charges of molesting his stepdaughter but denied raping the girl who was only 12 when the offences first took place.

However, he changed his plea to guilty for all the 22 charges, including raping her, fondling her breast, touching her private parts, inserting his finger into her vagina and inserting his penis into her mouth, before Sessions Court Judge Datuk Julie Lack Abdullah.

The offences took place at a house in Kampung Tersusun Baru, Lekir, between April 2016 and Sept 29 this year.

Among others, he was charged under Section 376B of the Penal Code with rape, which carries a jail sentence of between 10 and 30 years and whipping.

He was also charged under Section 14 (a) of the Sexual Offences Act Against Children 2017, and faced up to 25 years in jail and whipping, and up to 10 years in jail, or a fine or whipping, or any two of the penalties under Section 354 of the Penal Code for assault or the use of criminal force on a person with intent to outrage modesty.

He carried out the acts while the girl’s mother, whom he had divorced, went out or was asleep in a different room when they were still staying in the same house.

In the victim’s impact statement read in court told of how she was scared of her stepfather, as he had threatened her. She said she hated her stepfather and was really happy when her mother filed for a divorcee, which meant he would no longer stay in the same house.

The mother realised that her ex-husband had been raping and molesting her daughter when she saw photos on an SD card folder titled “AnakKu” on Sept 30.

She lodged a police report on the same day, and the accused was arrested.

Deputy Public Prosecutor Naidatul Athirah Azman said the court should hand down a deterrent sentenced.

“The victim had been used by the accused for his own sexual satisfaction. The victim is traumatised, ” she added.

The accused lawyer Robert Gnanarajan asked the court for a lighter sentenced as his client had saved the court cost and time by pleading guilty to the offences.

The judge sentenced him to 38 years in prison, with 23 strokes of the rotan.

“You have saved the court’s time and cost, which means the victim need not come to court and relate the traumatic incidences all over again, ” she said.
