IPOH: Ipoh Timur MP Thomas Su Keong Siong was charged again under the Peaceful Assembly Act 2012 following a Court of Appeal ruling that Section 9(1) of the Act is constitutional.
In May 2014, Su of DAP was given a discharge not amounting to an acquittal by a Sessions Court which had then declared the section unconstitutional.
The Court of Appeal subsequently overulled the lower court’s decision.
The section deals with failing to notify the police 10 days prior to the Blackout 505 rally at Wisma Chin Woo on May 9 three years ago.
On Friday, Su appeared in court again charged under the same section of the Act.
Deputy Public Prosecutor Harris Ong Mohd Jeffery Ong asked that bail be fixed at RM10,000.
Su's counsel Ramkarpal Singh argued for a RM4,000 bail saying that Su was charged under the same Act previously and was given a RM4,000 bail.
Judge Ikmal Hishan Mohd Tajuddin set bail at RM8,000 with one surety.
He set Nov 18 for mention.
