Myvi drivers in DUKE crash claim trial


KUALA LUMPUR: The two Perodua Myvi drivers involved in an accident which killed a couple and their seven-month-old girl on the DUKE highway have pleaded not guilty at a magistrate’s court here.

Siti Noor Aini Mohd Said, 35, and Mohammad Fizal Reza Jamauddin, 31 were charged Friday with causing death by reckless driving under Section 41(1) of the Road Transport Act 1987.

Both pleaded not guilty to the charge.

Magistrate Noorul Fhaiez Mohd Nayan fixed bail at RM9,000 with one surety each and fixed June 22 for mention.

Deputy public prosecutors Suhaimi Ibrahim and Nadia Malek Fauzie had earlier applied for RM15,000 bail with one surety each.

Lawyer S. Prakash, who represented Siti Noor Aini and lawyer Hashim Ibrahim, who acted for Mohd Fizal, however asked for reduced bail at RM5,000 each.

The accused were ordered to surrender their passports to the court until after the case. Their driver’s licences have also been suspended.

If convicted, the duo face a minimum of two years’ jail and RM5,000 fine.

Last Saturday, 35-year-old Fairuz Nizam Husain, his wife Nova Safitri Azhari, 25, and their baby girl Nur Firuza Annisa, were killed in a crash involving three vehicles at KM6 of the DKE highway.

The tragedy resulted in a public uproar after it appeared that the Myvi drivers had been racing on the highway with several others when the accident occurred.

The Mitsubishi Pajero Sport Fairuz and his family were travelling in overturned after it was rammed into by one of the speeding Myvis, causing all three occupants to be thrown out of the four-wheel drive vehicle.

Fairuz died on the spot while his wife and daughter died at the Kuala Lumpur Hospital.

The couple has two other daughters - Nur Firuza Amira, seven, and Nur Firuza Akila, three. 

One Myvi driver escaped uninjured while the other had minor injuries.

Lawyer Cantius Leo Camoens held watching brief for the family of Fairuz at the court.

The victims’ family members were not seen in court.
