PUTRAJAYA: The Federal Court has questioned the necessity to consider several questions posed to it by R. Subashini, who is seeking leave to appeal against a Court of Appeal decision ordering her to go to the Syariah Court to fight for her matrimonial and custodial rights.
Federal Court judges Justices Abdul Hamid Mohamad, S. Augustine Paul and Abdul Aziz Mohamad were of the opinion that the questions agreed to by the counsels for Subashini and her estranged husband T. Saravanan would predetermine the issues in the divorce petition filed by the wife, which was still pending in the High Court.
