Do not confuse civil marriage solemnisation with religious rites, says Registration Department

PETALING JAYA: Civil marriage solemnisation under national law must not be confused with religious rituals, the National Registration Department clarified on Sunday (Oct 18).

In a statement addressing recent public misunderstandings, the department said the importance of distinguishing between religious marriage rites and the legal registration of non-Muslim marriages under the Law Reform (Marriage and Divorce) Act 1976 [Act 164].

"Every religion, whether Buddhism, Christianity, Hinduism, or others, has its own marriage customs and practices, which remain the sole prerogative of their respective adherents and religious leaders," it said.

"However, from a legal standpoint, non-Muslim marriages under Act 164 must be solemnised and registered according to prescribed legal provisions to ensure full legal recognition."

The department explained that civil marriages can take place at the department offices, or at approved places of worship and community associations through appointed Assistant Registrars of Marriages.

"Therefore, civil solemnisation by authorised persons under Act 164 should not be equated with performing a religious ritual. This is a civil duty carried out under federal law, not an assumption of religious leadership," the statement read.

The department said that while the government fully respects religious freedom and cultural diversity, compliance with civil law remains essential to protect the legal rights and interests of couples, children, and families.

The department urged the public to refrain from using the distinction between civil laws and religious rituals to spread inaccurate or misleading claims.

"The department remains committed to conducting civil marriage matters professionally, orderly, and lawfully, while respecting the diverse faiths and traditions of the country," it added.

The clarification follows a previous statement in which the department advised the public to stop sharing an old video showing Home Minister Datuk Seri Saifuddin Nasution Ismail officiating a non-Muslim civil marriage, warning against misleading narratives that spark public confusion.
