Jempol MP probe papers sent back to cops, says Home Ministry


KUALA LUMPUR: Prosecutors have sent the investigation papers on Jempol MP Datuk Shamshulkahar Mohd Deli's state election campaign speech back to the police with further instructions, says the Home Ministry.

In a written parliamentary reply, the ministry said the papers were referred to the Negri Sembilan Prosecution Office on Aug 21 and returned on Sept 3 with several instructions for the investigating officer.

It said police were completing the instructed matters and would resubmit the papers to the state prosecution office.

The case is being investigated under Section 4A(1) of the Election Offences Act 1954, Section 505(b) of the Penal Code and Section 233 of the Communications and Multimedia Act 1998.

"The government always respects the principle that a person is presumed innocent until proven otherwise," the ministry said in reply to Jelutong MP RSN Rayer.

Rayer had asked why Shamshulkahar had yet to be charged over remarks Rayer described as defamatory and seditious.

Police opened the paper during the campaign after a 55-year-old man who watched a video of the speech in Seremban Jaya lodged a report.

DAP leaders, including Rayer, also lodged police reports over the speech.

Negri Sembilan went to the polls on Aug 1.
