Teacher, Terengganu Islamic Foundation ordered to pay RM47,000 over student's injury


KUALA TERENGGANU: The Kuala Terengganu High Court has ordered a religious school teacher and the Terengganu Islamic Foundation (YIT) to pay RM47,000 to a former student who was seriously injured after being slammed onto a wooden chair four years ago.

Lawyer Mohd Hazwan Hamidun, who represented Muhammad Izz Anaqi Mohd Izwan, now 13, said High Court judge Yusrin Faidz Yusoff made the ruling on Wednesday (Sept 30), which comprised RM30,000 in general damages for injuries, RM17,000 in costs, with 5% annual interest.

He said the court also ordered the first defendant, Ahmad Mursyidin Abdullah, and YIT as the second defendant, to pay the annual interest from the filing of the suit in January 2023 until full settlement, after allowing the appeal filed by the victim through his mother, Nor Azlina Mohd Yasin.

"The High Court's decision set aside the Kuala Terengganu Sessions Court's earlier dismissal of Muhammad Izz Anaqi's claim," he told reporters at the Kuala Terengganu Court Complex here on Thursday (Oct 1).

He said the High Court found that the Sessions Court judge had erred and failed to assess the evidence of two eyewitnesses who were in the same classroom as the victim and the expert medical report from Sultanah Nurzahirah Hospital, which confirmed that the injury was caused by a forceful impact.

In January 2023, the victim, who was then in Year Three and nine years old when the incident occurred on July 6, 2022, filed a suit through his mother at the Kuala Terengganu Sessions Court against a KAFA teacher for alleged negligence that resulted in a fracture of his tibia or fibula at a school in Marang district. – Bernama
