KUALA LUMPUR: Datin Seri Rosmah Mansor has filed an application at the Court of Appeal to submit new evidence in her appeal against her conviction and sentence in the RM1.25bil solar hybrid project case.
In a notice of motion filed on July 21, the wife of former prime minister Datuk Seri Najib Razak is seeking permission under the Courts of Judicature Act and Court of Appeal Rules to introduce three new documents as evidence.
The documents include a cover letter from law firm Messrs Shamsuddin & Co dated July 10, a police report lodged by key prosecution witness Rayyan Radzwill Abdullah on July 10, and a statutory declaration affirmed by Rayyan on the same date, along with an attached affidavit from August 2020.
Rosmah is also seeking to recall Rayyan, a former consultant and business partner of Jepak Holdings Sdn Bhd, to give additional oral testimony, either before the Court of Appeal or the High Court.
On Sept 1, 2022, the High Court convicted Rosmah on three corruption charges under Section 16(a)(A) of the Malaysian Anti-Corruption Commission (MACC) Act 2009.
She was found guilty of soliciting RM187.5mil and accepting RM6.5mil in bribes from former Jepak Holdings managing director Saidi Abang Samsudin through her former aide, Datuk Rizal Mansor. The bribes were an inducement to help Jepak Holdings secure the RM1.25bil solar hybrid project for 369 rural schools in Sarawak from the Education Ministry.
Rosmah was sentenced to 10 years’ imprisonment on each charge, to run concurrently, and fined RM970mil. She was granted a stay of execution pending her appeal.
The Court of Appeal has scheduled a 16-day hearing starting Sept 1 to hear her appeal against the conviction and sentence.
