SANDAKAN: An undocumented 19-year-old foreigner was sentenced to 14 years' jail and eight strokes of the cane after pleading guilty to robbing and injuring a 61-year-old woman during a house break-in in Sandakan.
Alimanja Aroiski was also charged with raping the victim, but the Sessions Court rejected his guilty plea on Friday (June 19) due to discrepancies in the medical report and deferred further proceedings pending the victim's latest medical assessment.
Sessions Court judge Roslinda Razali ordered the jail sentence to run from the date of his arrest on March 21.
According to the facts of the case, Alimanja entered the victim's house through a window at Taman Megah, Batu 7, Sandakan, at about 1.30am on March 21.
He then assaulted the woman and fled with valuables, including a gold bracelet and two mobile phones, resulting in losses estimated at RM20,000.
Alimanja pleaded guilty to voluntarily causing hurt while committing robbery under Section 394 of the Penal Code.
The court, however, declined to record his guilty plea on the rape charge under Section 376(1) of the Penal Code pending the victim's latest medical report and fixed July 27 for further mention.
The court also ordered that Alimanja, who does not possess valid identification documents, be referred to the Immigration Department for deportation after serving his sentence.
