Melaka technician claims trial to 52 charges including raping, sexually assaulting daughter


MELAKA: A 41-year-old technician claimed trial at the Sessions' Court in Ayer Keroh here to 52 counts of charges including raping, committing physical sexual assault and taking nude photographs of his biological daughter.

The accused's plea was recorded before Judge Haderiah Siri on Tuesday (Aug 12).

Under 17 charges of rape, the father of six was accused of committing incest with his 18-year-old biological daughter, an offence under Section 376B of the Penal Code, which carries a prison sentence of between 10 and 30 years as well as whipping upon conviction.

He also faced 34 charges of intentionally committing physical sexual assault by forcing his daughter to perform sexual acts.

These offences are punishable under Sections 14(b) and 14(a) of the Sexual Offences Against Children Act 2017, read together with Section 16 of the same Act.

Sections 14(b) and 14(a) each carry a maximum prison sentence of 20 years and whipping, while Section 16 provides for a jail term of up to five years and a maximum of two strokes of the rotan, if convicted.

All 52 offences were allegedly committed between 6.50am and 7.15am from May 12, 2025 to Aug 2, 2025, at a house in Tambak Paya in the Melaka Tengah district.

The accused also faced one charge of producing child pornography by taking two nude photographs of his daughter in the bathroom when she was 17 years and 11 months old.

The alleged offence took place at the same address at about 7am on July 9.

Deputy Public Prosecutor Muhamad Ehsan Nasarudin proposed that the unrepresented accused be granted bail of RM20,000 for each of the 52 charges, along with additional conditions.

These included a prohibition on contacting the victim and prosecution witnesses, reporting to the nearest police station once every two weeks and surrendering his passport to the court.

The court granted bail of RM90,000 and imposed all additional conditions sought by the prosecution.

The next mention date is fixed on Sept 18.
