AI deepfake porn case: Teen's detention exceeded remand period, rep claims


KULAI: An assemblyman claims that police detained the 16-year-old private school student alleged to have created AI deepfake porn images of his schoolmates past the stipulated remand period.

Senai assemblyman Wong Bor Yang said the remand period was supposed to end at 4pm on Monday (April 21), which meant the teenager should have been released or charged on the same day.

“However, the teen remained in police custody until today (Wednesday, April 23), when he was brought to a Magistrate’s Court here to be charged,” he told reporters at the court compound.

He said he was there because the teenager’s parents had asked for his help, and questioned whether the police may have made a mistake with the suspect's detention.

It was reported earlier that the teen's remand had originally been scheduled to end on Sunday but was extended by one day to Monday.

Wong added that the teenager's lawyer would also ask the court to let his client meet his father to discuss his plea.

“It has been 15 days since the student was arrested and his parents have not been able to (have a proper meeting with him,” he said.

The boy’s father was also seen speaking with Wong and the lawyer at the court compound.

It was reported that the teenager, who allegedly sold the pictures for as low as RM2 each to about a dozen people, is expected to be charged at a Magistrate's Court here.

Sources said he is expected to be charged under Section 292 of the Penal Code for the sale, distribution, or circulation of obscene materials and Section 233 of the Commu­nications and Multimedia Act 1998 for misuse of network facilities to share offensive and inappropriate content.

It was reported that the teenager, a former student from a Chinese school here, allegedly used AI to generate nude pictures of people, resulting in a 19-year-old girl lodging a police report after finding a nude image with her likeness on social media.

The first report was lodged in March, and he was arrested on April 8. At least 29 reports had been lodged against him up to April 15.

All transactions were allegedly done online. The principal of the school has reportedly resigned as well.
