3R issues investigated without fear, favour, probe into Muhyiddin's remarks ongoing, says Home Minister

KUALA LUMPUR: All 3R (race, religion and royalty) cases are investigated by the police without fear or favour, Datuk Seri Saifuddin Nasution Ismail assures the Dewan Rakyat.

“The Home Ministry would like to give the assurance that all 3R cases are investigated by the police without fear and favour, regardless of one’s political leaning,” he said in a parliamentary written reply dated Dec 11.

“I have given the police the full freedom to carry out their investigations transparently and without disturbance.

"Therefore, I would like to remind all parties to refrain from making any statements that touches on 3R elements,” he added.

Saifuddin was responding to a question by Tan Sri Abdul Hadi Awang (PN-Marang), who had asked him to spell out the definition of cases that can be categorised as 3R.

Abdul Hadi had also asked what guarantees are in place to see that the law is enforced in a just manner and not to restrict the Opposition’s role in the parliamentary democracy.

Saifuddin said the Sedition Act, Penal Code and the Communications and Multimedia Act (CMA) are the laws governing the 3R issues.

Section 4 and Section 3(1) of the Sedition Act have spelt out actions that are deemed seditious.

As for the Penal Code, Section 298 and Section 298A are used to investigate offences that could disrupt religious peace.

Section 505, meanwhile, is used on offences related to inciting communal tension.

As for the CMA, Section 211 covers offences related to offensive content while Section 233 is related to the misuse of network and services to spread obscene, indecent, false, menacing, or offensive content.

“This means any act, statement, post, speech, publication that touches on 3R and goes against the above laws is prohibited and investigations can be carried out according to provisions in the said laws,” he said.

To another question by Datuk Rosol Wahid (PN-Hulu Terengganu), who asked on the update on the investigations into Tan Sri Muhyiddin Yassin’s statutory declaration case, Saifuddin said the investigation is ongoing.

"The investigation papers were submitted to the Attorney General's Chambers on Sept 11, and it has since been returned for further investigations," Saifuddin Nasution said.

On Aug 20, Muhyiddin handed over documents to the police in connection with investigations into the 3R issue.
