JOHOR BARU: The Sessions Court here has postponed the re-mentioning of five family members of the Ulu Tiram police station attacker due to incomplete reports.
Sessions Judge Rasidah Roslee set Sept 24 as the new mention date after the prosecution had earlier appealed for a new date to submit the terrorism expert's report.
Deputy public prosecutor Yazid Mustaqim Roslan told the court here on Monday (Sept 2) that the prosecution needed about a month to prepare the report.
This is the second time that the re-mentioning of the five accused, who are family members of the Ulu Tiram police station attacker, has been postponed due to an incomplete terrorism expert's report.
Lawyer Arief Firdaus Ashikin, who represented the family, requested to the court that the new re-mentioning date should be the final before the case is transferred to Kuala Lumpur High Court. He argued that the five accused had been charged and placed under custody since June.
Meanwhile, Rasidah also granted a discharge not amounting to an acquittal (DNAA) to Radin Imran Radin Mohd Yassin, 62, on one of his four charges.
However, at the same time, the prosecution filed a new charge against the father of four for allegedly possessing a book titled “Hakikat Islam & Hakikat Syirik” by Abu Sulaiman Aman Abdurrahman, linked to Islamic State.
He was charged under Section 130JB(1)(a) of the Penal Code (Section 574), which carries seven years imprisonment or a fine and seizure of the material.
On June 19, Radin Imran, together with four other of his family members, were charged at the Sessions Court with a total of nine charges between them.
They are his Singaporean wife, Rosna Jantan, 59; and their children Radin Romyullah Radin Imran, 34, Farhah Sobrina Radin Imran, 23, and Mariah Radin Imran, 19.
In the May 17 attack on the Ulu Tiram police station, two policemen, Constable Ahmad Azza Fahmi Azhar, 22, and Constable Muhamad Syafiq Ahmad Said, 24, were killed. Another police officer, Sergeant Mohd Hasif Roslan, 38, was injured with two gunshots to the shoulder and hip.
