SEREMBAN: A 47-year-old man has pleaded not guilty at the Sessions Court here to raping his underage daughter.
The man, who is an OKU card holder, claimed trial after the charge was read to him before judge Datin Surita Budin.
He was charged with committing the offence on his then 16-year-old daughter, at a house in Kota, Rembau, on Nov 12, 2023.
The accused was charged under Section 376(3) of the Penal Code which provides for a jail term of between eight and 30 years, and a whipping of not less than 10 times.
Deputy public prosecutor Goh Hsiao Tung told the court her team had yet to obtain the relevant reports and it would also not be offering bail as the accused was facing another charge against the same victim.
“The same victim was also said to have been assaulted by the accused after the alleged rape.
“The prosecution is objecting to bail as there is a possibility that he may harass the victim who is temporarily under the care of the Welfare Department,” she said.
In pleading for bail, the accused, who was unrepresented, claimed to be drunk on the day of the alleged assault.
“I hope the court offers me bail as I have to take care of my father and three children.
“I do odd jobs and need to work so I can provide for them,” he said, adding that he had lost one eye in an accident some time ago.
In denying bail, Judge Surita told the accused to appoint a lawyer and fixed March 6 for mention.
At the Kuala Pilah Sessions Court later, the accused pleaded guilty to a charge of voluntarily causing the victim hurt by using dangerous weapons or means.
He was charged with committing the offence at the same house at around 11.45pm on Jan 23 this year.
The accused was charged under Section 324 of the Penal Code read together with Section 326A, which provides a jail term of up to 20 years, whipping or a fine or any of the two punishments.
Judge Norma Ismail then fixed March 5 for sentencing.
Police had arrested the accused on Jan 24 after a clip of a man allegedly hitting a young girl went viral.
The girl, who required 12 stitches for injuries, later told a doctor examining her that her father had raped her last November.
