Cop stands trial for raping teen

KUALA LUMPUR: Two suspended policemen have claimed trial to criminal charges in a rape-and-extort case involving a minor.

L/Kpl Muhammad Fazrul Razzi Yunus, 31, who wore a face mask as he was led into the Sessions Court, faces four counts of sexual offences allegedly committed against the 17-year-old victim.

According to the first charge, he allegedly raped the girl inside a police patrol car by the roadside of Jalan Persiaran Saujana Ampang at about 10.30pm on Jan 9.

For the second until the fourth charges, the accused allegedly committed unnatural sex, carnal intercourse against the order of nature, and sexual assault against the same victim at the same place and time.

For charges under Section 376(1) and Section 377C of the Penal Code, and Section 14(a) of the Sexual Offences Against Children Act 2017, the accused could be jailed for a maximum of 20 years and be liable for whipping.

Meanwhile, for the offence under Section 377CA of the Penal Code, the accused faces up to 30 years in jail and whipping if convicted.

Muhammad Fazrul, who is a father of two, pleaded not guilty to the charges after they were read out before Sessions Court judge Norshila Kamaruddin here yesterday.

Deputy public prosecutor Nor Azizah Mohamad offered bail at RM20,000 for each of the offences.

“We also asked the accused not to disturb the witness and to report himself at the nearest police station,” said the prosecutor.

Lawyer G. Visvanathan Nair, who represented Muhammad Fazrul, asked for minimum bail on grounds that his client is not a flight risk.

“My client is suffering from myasthenia gravis, a chronic autoimmune neuromuscular disorder causing muscle weakness and fatigue due to impaired communication between nerves and muscles.

“Bail also should not be used to punish a person as he is deemed innocent until proven guilty by this court,” he said.

The court fixed RM20,000 bail for all charges and fixed March 12 for mention.

At the Magistrates’ Court, Muhammad Fazrul also stood to face another charge of extortion with his partner, Kons Muhammad Adib Aikal Sharul Nizam.

They were jointly accused of extorting RM500 from the victim and her boyfriend by threatening to spread their intimate video near Jalan Ampang Hillview at the same date and time.

The charge under Section 384 of the Penal Code carries a maximum of 10 years’ jail, a fine or whipping upon conviction.

Magistrate Amalina Basirah Md Top fixed RM4,000 bail for each of the accused.

It is understood that the two men raised the bail.
