Shop assistant fined RM5,000 for having porn on mobile phone


TAIPING: A shop assistant was fined RM5,000 in default eight months jail by the Magistrate’s Court here on Wednesday (May 17) for possessing pornographic materials on his mobile phone.

Muhammad Fitri Ishak, 26, who works at a shop selling coconut milk, pleaded guilty to the charge before magistrate Nur Atiqah Sapari.

He was charged with possessing 67 pornographic images and 55 lewd videos on his phone at Hospital Taiping here at 12.15pm on Feb 16 last year.

He was charged under Section 292 of the Penal Code which carries a maximum jail sentence of three years or a fine or both.

Muhammad Fitri's lawyer Ng Wei Jun, from the National Legal Aid Foundation, said in mitigation the accused had both parents and a younger sibling to care for, and earned only RM1,200 monthly.

“He has promised not to repeat the offence,” he added.

Malaysian Communications and Multimedia Commission (MCMC) prosecution officer Siti Hajar Sulaiman urged for a deterrent sentence.

According to the statement of facts, the MCMC arrested the accused after receiving a report.

The accused paid the fine.
