Ain and dad file counterclaim against her former teacher


PETALING JAYA: Teenager Ain Husniza Saiful Nizam (pic) and her father have filed a counterclaim against a former teacher who made lewd jokes in class, claiming she suffered from emotional distress and nervous shock as a result of the incident.

Ain made headlines after exposing her teacher for making rape jokes in class, in May last year.

Her lawyer Datuk Sankara Nair confirmed the counterclaim filed by the father and daughter.

“As a result of the lewd joke, which is deeply oppressive and psychologically damaging, Ain has suffered emotional distress and/or serious nervous shock,” the statement of defence stated.

“Not only has Ain’s legal rights for her safety been violently breached, she has also suffered from extreme fright, sadness, humiliation, anxiety, and the constant threat of violence and personal injuries.”

Her former teacher at SMK Puncak Alam Khairul Nizam Sanuddin, school principal Sarimah Mohammed Nor, state education director Anismah M Noh, Education Minister Datuk Dr Mohd Radzi Jidin and the Malaysian government were named as the defendants.

Ain and her father, Saiful Nizam Abdul Wahab, claimed the teacher had made lewd jokes with malice and conducted unreasonable verbal harassment.

The claim stated the teacher’s action was “calculated to cause” anxiety, fear and stress in Ain.

They also claimed the teacher’s action had violated the Sexual Offences against Children Act 2017, among others.

Last November, Khairul Nizam had filed a defamation suit against Ain and her father. He sought RM1mil in damages for the alleged defamatory remarks made by Ain.

Ain made headlines after she exposed her teacher for making lewd jokes. She used TikTok to expose the deed, which sparked national outrage.
