Man claims trial to 55 counts of incest, nine counts of rape


KLANG: A 42-year-old father of five claimed trial at the Sessions Court here with 55 counts of incest with his daughter and nine counts of raping her friend.

The man - who cannot be named to protect the identity of his daughter - pleaded not guilty to all 64 charges before judge Datin M. Kunasundary on Wednesday (Feb 24)

He allegedly raped his daughter from April 2019 to Jan 2021 and her friend from Aug 2020 to Jan 2021.

Both alleged victims were classmates and also worked at his sugarcane juice stall.

If found guilty of the 55 charges under Section 376B (1) of the Penal Code for incest, he faces a maximum 30-year jail term and whipping for each charge.

Additionally, he also faces a maximum 20-year jail term and whipping if found guilty of the nine charges of rape under Section 377B (1) of the Penal Code.

In submissions for bail, the man's counsel Khairul Naim Rafidi pleaded to the court for bail, citing that his client was innocent until proven guilty.

“Moreover, if he is detained in prison, it may adversely affect my client and others in the current Covid-19 pandemic, ’’ said Khairul Naim.

However, DPP Nurul Qistini Qamarul Abrar argued that the offences committed by the man were serious in nature and he could also be a threat to the two victims, moreso as he and his daughter lived in the same house.

“As for the Covid-19 pandemic, the prison authorities have done the necessary and all the inmates have been screened and quarantined before being allowed into prison, ’’ she said.

Kunasundary denied bail and fixed the case for mention on March 24.
