THE Works Ministry has come up with a list of frequently asked questions regarding construction activities in areas placed under the movement control order.
Q: Is the construction sector subject to all MCO regulations?
A: Yes, all operations and activities of the construction sector in areas under the MCO are required to comply with the relevant MCO standard operating procedure (SOP).
Q: Is construction work in the states under the MCO allowed to operate?
A: Construction work must be temporarily halted, though exceptions are given for work listed under essential services, such as:
i. Maintenance and critical repairs, which is any work, if not continued, that may bring danger or harm to personnel, the public and the surrounding environment. These include:
> slope repairs
> road repairs
> bridge repairs and upgrades
> commercial buildings and office repairs
> private home repairs
> traffic management control
> lifts/escalators and other critical mechanical and electrical equipment that require periodic inspection
> critical services premises repairs, upgrades and maintenance
> traffic light repairs
> construction of Bailey bridge at locations with collapsed bridges
> tunnelling work
> emergency services as stipulated under contract
> maintenance, cleaning, and drying of areas with stagnant water, fogging at construction sites to avoid mosquito and other pests from breeding
> other works that may bring harm if left uncompleted
> repair and upgrade to railway systems such as the MRT, LRT and Komuter, among others.
ii. Major public infrastructure construction work
Work that uses heavy machinery or does not involve a lot of workers to gather in an area, or situated far from the public, or construction sites that are located in remote areas. These include work at:
> highways and roads
> bridges and viaducts
> railway tracks
> infrastructure related to electrical systems
> infrastructure related to telecommunications
> infrastructure related to dams, drainage and sewerage
> infrastructure related to oil and gas
iii. Building construction work
Only allowed for projects that provide complete accommodation of workers on construction sites or Centralised Labour Quarters (CLQ).
Employers should also provide transport for staff from CLQ to the site and vice versa. Accommodation at construction sites and/ or CLQ must comply with the Workers’ Minimum Standards of Housing and Amenities Act 1990 (Act 446).
iv. Professional services/ consultants
Exemption only for those involved in areas listed under Items i-iii above. These professionals/ consultants are responsible for fully complying with the SOP. They also need to ensure that the workforce on-site is as small as possible and only implement duties deemed as critical while moving about the respective work sites.
v. Other services within the supply chain
Including supply of building material, delivery of materials, but limited to construction sites approved for operations as listed in Items i-iii.
All parties involved in the supply chain must be fully responsible to comply with the SOP to ensure the vehicles used in the delivery are disinfected, along with the materials being transported, other than recording the temperature before entering the site as well as logging their movements at the site’s entry and exit points.
Q: How does one obtain approval for construction work during the MCO?
A: All operating permits must be obtained from the International Trade and Industry Ministry (Miti) through Miti’s Covid-19 Intelligent Management System (CIMS) portal.
Q: What type of documents are required from contractors at sites?
A: Contractors are required to prepare and keep the following documents on site/premises for inspection by relevant authorities:
> project name and value
> location of the project (GPS coordinates)
> information of the officers in charge, that is:
> Director of the company who is in charge
> Project manager
> Project coordinator
> CLQ manager (if relevant)
> project implementation schedule
> total number of workers and the list of contract workers/ main company in accordance with their trade
> total number of workers and list of subcontractors as well as personnel in accordance with their trade (if relevant)
> list of material supplier and material used (if relevant)
> list of heavy machinery supplier, name of operator, licence and machinery that will be used (if relevant)
> records of workers’ movement, health screenings, site/premises cleansing and hygiene management
> CIDB pledge
Q: Will there be any operation hour limits imposed on construction sites?
A: Employers must comply with the operational hours set by the local authorities.
Q: Are construction workers allowed to be transported from one site to another?
A: No, it is not allowed.
Q: What are the documents required for construction workers to allow movement for them?
A: Workers must carry a valid working pass or an approval letter from their employers as well as Miti’s CIMS approval letter.
Q: What is the function of the contractor in order to control the number of workers on-site?
A: Contractors must limit entry/ exit movements at sites. The contractors are also required to ensure workers deployed at the sites do not mix around with local residents to curb the spread of Covid-19. Contractors must also prepare all the daily necessities on-site, including food.
Q: Is transport for workers to the site allowed to operate?
A: Contractors must provide transportation for workers and it is limited from the CLQ to the site both ways, without making any stops at other areas.
Contractors also should limit the entry and exit movement at CLQs and ensure that the daily necessities of workers are readily available.
Q: Who will be responsible for SOP compliance at worksites during the MCO?
A: The project management officer (pegawai penguasa projek) is responsible for ensuing full compliance to the SOP, and for controlling exit and entry movements at sites throughout the MCO.
Q: What type of screening is accepted for Covid-19 testing?
A: There are two types of diagnostic tests accepted for workers to screen for Covid-19:
Reverse transcription polymerase chain reaction (RT-PCR)
Rapid Test Kit for antigen (RTK-Ag)
Q: Is Covid-19 screening mandatory for all workers on-site?
A: It is mandatory for all foreign workers to be screened for Covid-19.
Q: Will you need to do a separate Covid-19 RTK-Ag test if the RT-PCR has already been done?
A: Foreign workers who had already taken RT-PCR test must still undergo the RTK-Ag test.
Q: What is the frequency of the RTK-Ag test?
A: At the moment, the frequency of RTK-Ag screening has not been set.
Q: Who will pay for the cost of the RTK-Ag test?
A: For Social Security Organisation (Socso) contributors, employers only need to fund the cost of services charged by the clinic because the RTK-Ag test kit has been supplied by Socso to the panel clinics. For foreign workers who are not Socso contributors, the screening cost must be fully borne by the employer.
