RM600 fine imposed on apartment owner


AN apartment owner who refused to comply with a tribunal order to fix a leak and compensate a neighbour was fined RM600 by the Ampang Magistrate’s Court.

The accused was initially ordered by the Putrajaya Strata Management Tribunal to repair the leakage in the complainant’s unit and to pay RM4,120 in cost.

Ampang Jaya Municipal Council (MPAJ), through its Commissioner of Building Department, initiated an investigation under Section 123 of the Strata Management Act 2013 (Act 757),

However, MPAJ, in a statement, said the individual failed to comply with the order.

“The individual was charged in the Magistrate’s Court and pleaded guilty to the charges under Section 123 of the Act for failing to comply with the tribunal’s award.

“The tribunal subsequently imposed a fine of RM600 and a 14-day jail sentence if the individual failed to settle the fine within the specified period,” said MPAJ in a statement.

The council said Section 123 further states that any party contravening the Strata Management Tribunal award may be fined up to RM250,000 or face imprisonment for a term not exceeding three years or both upon conviction.

MPAJ reminded property owners in strata buildings under its jurisdiction to take responsibility for their properties and to comply with council laws and regulations to avoid court action being taken against them.
