Sean Penn was caught on camera smoking at his table during Sunday night’s Golden Globes ceremony in Los Angeles, which is a possible crime.

Penn, 65, was spotted puffing away while seated with his One Battle After Another co-star Leonardo DiCaprio during the awards show at the Beverly Hilton in Beverly Hills. Another photo shows the two posing in front of a water glass that’s been turned into an impromptu ashtray.

Witnesses also reported seeing smoke during acceptance speeches throughout the night.

The Wall Street Journal reporter Ben Fritz posted a photo with the caption “This can’t be legal.”

In fact, Penn may have actually violated one of California’s clean air laws.

California law prohibits smoking in “hotels, motels & other lodging,” according to the California Department of Public Health. Most indoor hallways and stairwells are off-limits, too.

Vanity Fair reported that guests were scanning the theatre for easy access to outdoor areas for smoke breaks throughout the show.

Few exemptions to the law exist, however one involves “Theatrical Productions, if smoking is an integral part of the story.”
