MPSJ wins suit against developer


SHAH ALAM: The Subang Jaya Municipal Council (MPSJ) has won their suit against developer Mayland Valiant Sdn Bhd who sold hotel suites as serviced apartments without obtaining the appropriate permits.

"Hotel suites sold as serviced apartments would contravene and is inconsistent with planning permissions and guidelines as well as the traffic impact assessment report," said High Court Judicial Commissioner Rozana Ali Yusof here Wednesday.

JC Rozana said that the developers had obtained a license based on strata development as a serviced apartment and sold it to 1,200 purchasers.

The court found that the planning permission granted by MPSJ to Mayland on Oct 10 last year was for the purpose of a hotel.

She said the court also noted that Mayland had made two prior applications for a commercial building and a hotel apartment, which were rejected for various reasons.

The court allowed MPSJ's claim for a declaration that the planning permission granted is meant for the development to be used sole as a hotel and not as a serviced apartment.

Mayland was also issued an injunction preventing it from being used as a serviced apartment without proper planning permission.

MPSJ's claim for RM120,000 costs was also allowed by the court.

MPSJ's lead counsel was Karin Lim while Mayland was represented by Lai Wai Fong.
