KUALA LUMPUR: The corruption trial for businessman Datuk Tan Eng Boon, who was implicated in the case of former Federal Territories minister Datuk Seri Tengku Adnan Tengku Mansor, will be heard at the Sessions Court.
This was after High Court judge Justice Collin Lawrence Sequerah was informed that the prosecution had withdrawn their application for the transfer of the case to the High Court.
On Dec 26 last year, the prosecution had applied for a notice of motion before Sessions Court judge Azura Alwi for the case to be transferred to the High Court.
Earlier, lawyer Faisal Moideen, who represented the accused, had objected the prosecution’s application (for the transfer of the case).
“We had filed an affidavit to the High Court to object the application,” he said.
DPP Raja Lailawati Ali appeared for the prosecution.
On Nov 15 last year, 70-year-old Tan, who is the director of a real estate company, was charged with bribing Tengku Adnan and abetting him five years ago.
He allegedly gave RM1mil to Tengku Adnan via a Public bank cheque belonging to Pekan Nenas Industries Sdn Bhd, which was deposited into the latter’s CIMB bank account.
The monies were used as an inducement for Tengku Adnan to approve an application of a company to increase the plot ratio for a development in Jalan Semarak, Kuala Lumpur.
He was also charged with abetting Tengku Adnan for committing the corruption, which falls under Section 109 of the Penal Code.
Tan was released on RM700,000 bail in two sureties.
