NOT long ago a litigant withdrew his appeal to the Court of Appeal and requested that the deposit he was obliged to pay, be paid to his opponent as cost.
The presiding judge asked him why he had chosen to appeal in the first place. He said that when the High Court gave its decision by way of order in favour of the opposing party, he did not know the reason he had lost his case.
