PUTRAJAYA: The Federal Court postponed its decision on an appeal by former Selangor mentri besar Dr Mohd Khir Toyo (pic) against his conviction and 12-month jail sentence.
Dr Khir is scheduled to undergo an angiogram procedure at the National Heart Institute (IJN).
His counsel, Tan Sri Muhammad Shafee Abdullah, told Chief Justice of Malaya Zulkefli Ahmad Makinudin that his client needed to go for the procedure at about 5pm today (Thursday).
Justice Zulkefli, who chaired a five-member panel, fixed Sept 22 to deliver a decision.
The panel also included Justices Ahmad Ma'arop, Hasan Lah, Jeffrey Tan Kok Wha and Ramly Ali.
Dr Khir, 50, was admitted to the IJN on Wednesday after he collapsed and was unconscious while jogging. He was rushed to Selayang Hospital and later was transferred to IJN.
Dr Khir was charged with obtaining for himself and his wife, Zahrah Kechik, 50, two lots of land and a bungalow at No 8&10, Jalan Suasa 7/1L through Ditamas Sdn Bhd director Shamsuddin Hayroni.
The properties were bought at RM3.5mil, in contrast to the price of RM6.5mil paid for it by Ditamas on Dec 23, 2004.
He committed the offence with the knowledge that Shamsuddin had dealings with him in his official capacity as Selangor Menteri Besar at the time.
On May 30, last year, the Court of Appeal rejected Dr Khir's appeal against his graft conviction.
The panel unanimously upheld the High Court's findings, ruling the trial judge did not make any appealable error in deciding to reject Dr Khir's defence and convict him.
The Court of Appeal also upheld the court order for Dr Khir to forfeit the ownership on the property obtained and hand it over to the government.
Dr Khir was found guilty by a Shah Alam High Court on Dec 23, 2011 for knowingly purchasing two pieces of land and a bungalow in Section 7, Shah Alam at a much lower price than its original value.
