SHAH ALAM: A PKR member has sued Ampang MP Zuraida Kamaruddin and two others for allegedly rigging the party’s division election.
Nasharudin Md Isa, 51, who is an Ampang PKR member, filed the suit at the High Court registry here.
He named election committee chairman Datuk Johari Abdul, the election committee and Zuraida as the first, second and third defendants respectively.
In his statement of claim, Nasharudin said the division election, held at Dewan Nusa Bakti in Bandar Baru Ampang on May 11, was defective and disorganised.
He claimed that manipulation, cheating and injustice had occurred throughout the election process to select the Ampang division chief.
The position was contested by Zuraida and two other candidates
M. Pon Rengam and Abdul Halim Mohammed Yusof.
Nasharudin said that after polling closed, representatives of Pon Rengam and Abdul Halim had complained and called for the election to be cancelled due to the discrepancy in the number of ballot papers and voter turnout.
They claimed the total number of ballot papers returned was 1,151 when the voter turnout was only 1,115.
A head monitor elected by the committee agreed to the complaint and declared the election cancelled, but second defendant Johari continued with the counting of the ballot at the party headquarters in Petaling Jaya.
On June 11, the committee released the final result of the poll where Zuraida was declared the winner with 672 votes, while Abdul Halim secured 318 votes and Pon Rengam 30 votes.
The plaintiff claimed there were elements of corruption committed by Zuraida or her representatives or supporters in the polling.
The plaintiff also believed the confidentiality of the votes was not guaranteed because there were no covers or partitions at the table where ballot papers were marked to conceal their votes.
He sought declaration that the ballot counting carried out at the PKR headquarters on June 11 and the polling on May 11 were invalid.
The plaintiff also sought an order for the polling to be carried out again in 30 days after the order is issued by court.
He further sought costs to be borne by the defendants and other reliefs deemed fit by the court.
