THE High Court yesterday upheld Section 377A of the Penal Code, dismissing a legal challenge by two men against the law that makes homosexual sex a crime.
In a 92-page judgment, Justice Quentin Loh concluded that the law did not violate the Constitution. Whether it should be kept or repealed is a matter for Parliament to decide, not the courts, he said.
