Malaysia Competition Commission can commence investigations in three ways


THE Malaysia Competition Commission (MyCC) can commence investigations under the Competition Act 2010 (CA) in three ways: at the direction of the Minister (defined in the Act as “the Minister charged with the responsibility for domestic trade and consumer affairs”), where the MyCC has reason to suspect an infringement, or as a result of a complaint by any person.

Since the CA came into force on Jan 1, 2012, the MyCC has received numerous complaints about anti-competitive conduct. Many of these complaints have resulted in the MyCC commencing investigations. Some of the complainants are now anxious to know the outcome of their complaints and are asking why the MyCC is taking so long to reach a decision.
