PETALING JAYA: The appearance of an Appeal Court’s retired judge as a counsel before a lower court could have an intimidating effect on judges, says a legal expert.
Former United Nations Special Rapporteur on the Independence of Judges and Lawyers Datuk Param Cumaraswamy said a policy should be formulated to discourage retired judges, especially from the Appeal Court, from appearing as counsel in a High Court or subordinate court.
