SIBU: Her husband has raped a 13-year-old girl in front of their 11-year-old son. Instead of reporting the matter to the police, the woman slapped the victim on her face including stripping her naked and pressing a cigarette butt on her shoulder and ear.
She told the magistrate's court here on Tuesday that she had assaulted the victim as she was angry that the teenager had sex with her husband.
The court, however, did not accept her reason and sentenced her to two years in jail and fined RM4,000 in default four months’ imprisonment.
The accused, Emok Sulok, 42, could not pay the fine and opted for the default sentence.
In her mitigation before sentencing, she pleaded for leniency saying that she had to look after the children and on the day of committing the offence, she had just returned from the hospital for her regular check-up for high blood pressure.
The accused was charged under Section 324 of the Penal Code for assault.
According to the facts of the case, at about 8am on June 19, 2014 at a workers quarters of a charcoal factory in Engkilo, about one hour from here, the accused after being told of the matter, summoned the victim to the front of the house.
Her neighbour then asked why she was cutting and shaving the victim's hair. The accused replied that she was angry that the victim had sex with her husband.
She then asked the victim to take off her clothes which the teenager refused to do so. The accused forcibly took it off. She then ordered the victim to stand naked under the sun.
Not satisfied with that, the accused slapped her and also tried to burn her left shoulder and ear with a cigarette butt.
Police arrested her and her husband, 51, at 12.50pm on June 20 at a construction site at Jalan Wawasan.
It was reported that at about 6pm on June 18, the victim was alleged to have been raped at the accused's home. The victim did not retaliate for fear of her safety.
The act was witnessed by the alleged rapist's 11-year-old son who reported the matter to the accused.
The victim related the incident to her brother which resulted in the arrest of the duo.
Both have been staying with the accused's family for about two months after being disowned by their own parents.
The man has been released on police bail pending a chemistry report before being charged with statutory rape.
