United States antitrust and patent officials on Thursday said they no longer deem holders of industry-standard patents anti-competitive if they sue to stop the sale of infringing products, a far-reaching policy shift that they said supports innovation.
The new position could have seen chipmaker Qualcomm Inc, for instance, sue in an attempt to stop the sale of all models of Apple Inc's iPhones in Germany last year – rather than the limited number that were ultimately affected – without fear of being investigated by the US antitrust body.
