Clothing seller jailed five months for assaulting nephew


KUALA LUMPUR: A clothing seller was sentenced to five months' jail by the Selayang Magistrate's Court on Friday (Oct 10) for injuring his 10-year-old nephew by stepping on his head in May.

Magistrate Sabreena Bakar @ Bahari handed down the sentence against Norasmad Mohd Hussin, 36, after he pleaded guilty to committing the offence at a house in Taman Samudera, Batu Caves, around 1 am on May 26.

The court ordered the sentence to take effect from the date of his arrest on May 28.

The charge, under Section 323 of the Penal Code, provides for a maximum jail term of one year, a fine of up to RM2,000, or both.

According to the facts of the case, the victim's mother witnessed the accused stepping on her son's head in a room at their home. The accused claimed he acted out of anger, alleging the boy had stolen his lighter.

The prosecution urged the court to impose a deterrent sentence, while the defence counsel pleaded for leniency, saying their client was remorseful and would not repeat the offence. - Bernama
