Najib seeks court order for house arrest if new document exists


PUTRAJAYA: Datuk Seri Najib Razak is seeking an order from the Federal Court that, should an additional document exist, the authorities must enforce it and immediately transfer him out of the Kajang Prison to his home in Kuala Lumpur.

The former prime minister asked for the order to include allowing him to serve the remainder of his jail term under home detention.

Apart from hearing the app­lication, the Federal Court has also allowed Najib to appear on April 28 to hear the decision on the Attorney General’s (AG) application for leave to appeal regarding the existence of these additional documents, Bernama reported.

A three-judge panel, led by Chief Judge of Malaya Justice Hasnah Mohammed Hashim, granted Najib’s request to attend the proceedings.

On Jan 6 this year, the Court of Appeal remitted the case to the High Court for a hearing on its merits, after allowing Najib’s appeal against the High Court’s earlier dismissal of his application for leave to commence the judicial review.

Najib, 71, filed for a mandamus order compelling the respondents to disclose and confirm the existence of an additional document dated Jan 29 last year.

He named the Home Minister, Commissioner General of Prisons, AG, Federal Territories Pardons Board (covering Kuala Lumpur, Labuan and Putrajaya), Minister in the Prime Minister’s Depart­ment (Law and Institutional Reform), Director-General of the Legal Affairs Division in the Prime Minister’s Department and the government as respondents.

Najib has been serving his jail sentence since Aug 23, 2022, following his conviction for misappropriating RM42mil from SRC International Sdn Bhd. He filed a petition for royal pardon on Sept 2, 2022.

The High Court initially senten­ced him to 12 years in prison and an RM210mil fine.

However, the Pardons Board halved his prison term to six years and reduced the fine to RM50mil.
