Woman jailed for concealing birth of baby in Johor Baru

JOHOR BARU: A woman was sentenced to one day in jail and fined RM5,000 at the Magistrate's Court here for intentionally concealing the birth of a baby in January this year.

The accused, Nur Aqilah Ahmad Fairuz Zakri, 23, pleaded guilty after the charge was read to her in front of Magistrate A. Shaarmini on Thursday (June 20).

According to the charge sheet, Nur Aqilah intentionally concealed the birth of the baby by secretly burying its body, which had died before birth.

She committed the offence at Tanah Perkuburan Kampung Pertanian Masai at 6pm on Jan 26, 2024.

For this act, she was charged under Section 318 of the Penal Code for concealing a birth and secretly disposing of it, which carries a maximum penalty of two years in prison, a fine, or both upon conviction.

The case was prosecuted by Deputy Public Prosecutor Nurain Syafiqeen Mohd. Rozi, while the accused was not represented.

During the proceeding, Nurain Syafiqeen urged the court to impose a fitting punishment to serve as a lesson to the accused and the public, emphasising the severity of such actions, which prevent the birth of a life.

According to the facts of the case, a doctor reported that Nur Aqilah came to him, stating she was four months pregnant but did not wish to continue the pregnancy.

She admitted to taking two pills obtained from a friend to induce an abortion. She then went to the cemetery to bury the baby.
