Teen pleads not guilty to causing brother’s death

JOHOR BARU: A teenage girl was charged at the Juvenile Court here for causing the death of her younger brother at their home last week.

The girl, who is 17 years old, pleaded not guilty to the charge after it was read to her by an interpreter before magistrate Zuhainie Zull Kafli yesterday.

According to the charge sheet, the girl was charged with culpable homicide not amounting to murder for causing the death of her 16-year-old brother.

The offence was allegedly committed at a house in Kampung Ulu Pulai, Ulu Choh, here at about 1.50pm on Oct 19.

The eldest of the five siblings was charged under Section 304(b) of the Penal Code for causing death by negligence, which provides a maximum jail term of 10 years or a fine or both, upon conviction.

The case was prosecuted by Johor state prosecution director Tengku Amir Zaki Tengku Abdul Rahman and deputy public prosecutor Hayatul Wirdah Mohd Yunos.

The accused was represented by Abd Rahim Ali, Jihad Syahida Nadia Zakaria and Nur Zafirah Norizan.

During the proceedings, the prosecution requested bail to be set at RM10,000.

However, the defence counsel in mitigation appealed for a lower bail, saying that the accused was a minor and there was no reason for her to flee.

“The accused is just a teenager. The court should also consider her parents’ income and the fact that she will be taking her STPM exam next year,” said Abd Rahim when met outside the courtroom.

Zuhainie set bail at RM10,000 with one surety and additional terms, where the accused is required to report herself to the nearest police station every month.

The court also set Dec 5 for next mention.

It is understood that the girl’s father posted the bail.

On Oct 19, it was reported that two siblings were involved in a misunderstanding which ended in tragedy when the sister allegedly killed her brother with a knife.

Iskandar Puteri OCPD Asst Comm Rahmat Ariffin said the incident took place at a house in Ulu Pulai.

In a statement, he said that according to the victim’s mother, the 16-year-old had a fight with his sister over a seat in the car on the way home from school.

In a separate case, a civil servant pleaded not guilty at the Sessions Court to three charges of accepting a bribe of RM5,000 five years ago.

Azman Abdul Rahman, 54, made the plea before judge Datuk Ahmad Kamal Arifin Ismail.

The accused, who is a department head at the Johor Matriculation College in Tangkak, had allegedly accepted RM500 from a sports equipment company for equipment maintenance work.

He is also accused of accepting a bribe of RM3,500 from the same company for supplying sports equipment for the Matriculation Co-curiculum Carnival (Kakom) event at the same college.

He is also charged with accepting RM1,000 from a cleaning company at the college, knowing that it was related to his position at the college.

The offences were allegedly committed at his office and at a bank in Pagoh, Muar, in July, September and August 2017.

The offences under Section 17(a) of the MACC Act 2009 for accepting a bribe carry a jail term of up to 20 years and a fine of not less than five times the bribe involved, or up to RM10,000, whichever is higher, on conviction.

The case was prosecuted by Malaysian Anti-Corruption Commission prosecution officer Nik Lokman Hakim Nik Mohd Nor, while the accused was unrepresented.

Nik Lokman Hakim requested bail to be set at RM15,000.

The court set bail at RM7,000 with one surety, and ordered the accused to hand over his passport.

The court also set Nov 22 for next mention.

The accused posted bail.
