Fisherman who raped teen stepdaughter gets 202 years

IPOH: A fisherman was sentenced to a total of 202 years in jail and 23 strokes of the rotan after he admitted to raping, molesting and having unnatural sex with his underaged stepdaughter since April 2016.

But the 36-year-old will only serve 38 years as the judge ordered the sentences, a majority of them, to run concurrently and some consecutively from the date of his arrest on Sept 30.

A total of 22 charges were brought against him.

On Oct 11, he pleaded guilty to six of the charges of molesting her but denied raping the girl, who was only 12 when the acts were first committed.

He, however, changed his plea to guilty for all the 22 charges, including raping her, fondling her breasts, touching her private parts, inserting his finger into her vagina and inserting his penis into her mouth, before Sessions Court judge Datuk Julie Lack Abdullah yesterday.

The 22 counts of rape, molest, having unnatural sex and taking a video of her naked with his cellphone at a house in Kampung Tersusun Baru, Lekir, were said to have been committed between April 2016 and Sept 29 this year.

Among others, the accused was charged under Section 376B of the Penal Code for rape, which carries a jail sentence of between 10 and 30 years and whipping.

He was also charged under Section 14 (a) of the Sexual Offences Against Children Act and Section 354 of the Penal Code for assault or the use of criminal force on a person with intent to outrage modesty.

According to the facts of the case, the accused had taken advantage of the girl by forcefully going into her bedroom, removing her clothes, fondling her breasts and inserting his finger into her vagina before raping her.

He had also raped her in the living room.

The acts were said to have been committed when the girl’s mother, whom he had divorced but still stayed in the same house, had gone out or while she was asleep in a different room.

In the victim’s impact statement read in court, the girl had stated that she was scared of her stepfather as he had threatened her not to tell anyone.

She said she hated her stepfather and was really happy when her mother filed for a divorce, which meant he would no longer stay in the same house.

The mother only realised that her ex-husband had been raping and molesting her daughter when she saw photos on an SD card folder titled AnakKu on Sept 30.

She lodged a police report on the same day and the accused was arrested.

Deputy Public Prosecutor Naidatul Athirah Azman pressed for a deterrent sentence to serve as a lesson to others.

“The victim had been used by the accused for his own sexual satisfaction.

“The victim is traumatised,” she said.
