SEREMBAN: A teacher, who is also a part-time used car dealer, claimed trial at the Sessions Court here for allegedly committing criminal breach of trust by using proceeds from the sale of a car belonging to a client and another RM20,000 given by the same individual for personal use.
Zulkifli Ibrahim, 47, is accused of committing the offence at the CIMB Bank in Taman Semarak, Nilai between Feb 19 and 21.
He was alleged to have failed to use the proceeds from the sale of a Toyota Innova belonging to Rozinah Suhaili Ismail, 39, amounting to RM30,000 and another RM20,000 she gave him as the downpayment for a used Toyota Hilux costing RM100,000.
Rozinah allegedly handed over her car together with the vehicle’s title to the accused in front of the bank on Feb 20 and had credited another RM20,000 into his account on three occasions between Feb 19 and 21.
She later discovered that the accused did not pay the deposit for the Hilux and lodged a report after he failed to return the Innova as well as the RM20,000.
Zulkifli was charged under Section 408 of the Penal Code which carries a jail term of between two and 20 years, whipping and a fine.
He also pleaded not guilty to an alternative charge under Section 403 of the Penal Code for dishonest misappropriation of property.
Deputy Public Prosecutor Nur Akmal Mohamad Azri asked the court to fix bail at RM15,000 pending a remention.
Zulkifli who was unrepresented appealed for a lower bail as he had to provide for his four schoolgoing children and sick mother.
Judge Diana Md Razali set bail at RM10,000 and fixed Aug 5 for re-mention.
