SEREMBAN: A teacher who is also a part-time used car dealer has claimed trial at the Sessions Court here to committing criminal breach of trust.
He was alleged to have used the proceeds from the sale of a car belonging to a client and another RM20,000 given by the same individual, for his personal use.
Zulkifli Ibrahim 47, allegedly committed the offence at the CIMB bank in Taman Semarak in Nilai near here between Feb 19 and Feb 21.
He was alleged to have failed to use the proceeds from the sale of a Toyota Innova belonging to Rozinah Suhaili Ismail 39, amounting to RM30,000 and another RM20,000 she gave him to pay as down payment for a used Toyota Hilux costing RM100,000.
Rozinah allegedly handed over her car together with the vehicle's title to the accused in front of the bank on Feb 20.
She had also banked in another RM20,000 in total into his bank account on three occasions between Feb 19 and Feb 21.
However, Rozinah later discovered that the accused had failed pay the deposit for the Hilux and had asked him to return the Innova and the RM20,000.
The accused failed to do so and gave excuses that prompted the victim to lodge a report.
Zulkifli was charged under section 409 of the Penal Code that provides a jail term of between two and 20 years, whipping and a fine.
He also pleaded not guilty to an alternative charge under Section 403 of the Penal Code for dishonest misappropriation of property, which carries a punishment of between six months’ and five years’ jail, whipping and a fine.
Deputy public prosecutor Nur Akmal Mohamad Azri then asked the court to fix bail at RM15,000 pending a re-mention.
However, the accused, who was unrepresented, asked for a lower bail, claiming he had to provide for his four school-going children and his sick mother.
Judge Diana Md Razali then set bail at RM10,000 and fixed Aug 5 for re-mention.
