Carpet layer charged with raping 10-year-old daughter, denied bail

ALOR SETAR: A carpet layer, slapped with three counts of raping his then 10-year old biological daughter in their house four years ago, is claiming trial.

When the charges were read to him by a court interpreter in front of Sessions Court judge Sharifah Norazlita Syed Salim Idid, he nodded to show he understood.

The accused, 44, from Alor Setar, then pleaded not guilty to all three charges.

According to the charge sheet, on April 13, 14 and 15 in 2016, the accused had sexual intercourse with his daughter.

Under Section 376B (1) of the Penal Code, the offence carries a minimum 10 years and up to 30 years in jail, plus whipping upon conviction.

State deputy public prosecutor Mohd Alif Farhan Hassan asked that bail be denied as the case was very serious and because it was possible that the accused might harass the victim.

“The victim told her mother of the incestuous act, and the mother later lodged a police report against the accused.

“The victim is the only child of their marriage. She stayed with the accused when her parents divorced,” he said.

The accused was not represented.

Judge Sharifah Norazlita Syed Salim Idid fixed June 19 for re-mention pending the engagement of a counsel by the accused and the submission of case documents.

She told the accused he was not allowed bail.

The accused will spend time in the Alor Setar Prison while awaiting the next hearing date.
