KOTA BARU (Bernama): The parties asked to pay some RM4.3mil for negligence in an accident that left a tahfiz student in Kelantan paralysed for life, are asking for the amount to be reduced.
CT-One Corporation Sdn Bhd and Maahad Tahfiz Al-Hashimi have filed an appeal against the decision of the Kota Baru Sessions Court which ordered them and another party to pay RM4,334,507 to a former student who was involved in the van accident in June 2017.
The appeal to cancel or reduce the compensation was filed by the tahfiz's founder, Datuk Adnan Hashim at the High Court Registrar's Office here on Wednesday (Oct 3).
On Sept 23, Sessions Court Judge Nazri Ismail ruled that CT-One Corporation Sdn Bhd, Maahad Tahfiz Al-Hashimi and van driver Muhammad Hamzi Mohammad Husham, 25, were "100% responsible" for the negligence, and therefore they should pay the compensation.
The cost involved compensations to Muhammad Faiz Hafizuddin who had head injuries and a cracked spinal cord that resulted in lifelong paralysis and for the purchase of disposable diapers, food tubes, urine bags, beds, mattresses and a private nurse.
Accordingly, they were ordered to pay RM4,334,507 to Faiz as the first defendant and his mother Jahsuriawany Mustapha, 46, the second defendant.
In the van crash in June 2017, seven out of 12 tahfiz students (including one from Thailand) were killed. Five of them were killed at the scene while the other two died at the Kuala Krai Hospital.
The accident occurred when 12 tahfiz students were on their way to a programme at the Madinah Ramadan Kota Baru here, when the van skidded and rammed a house at in Kampung Telekong, Kuala Krai, Kelantan. - Bernama
