KOTA KINABALU: The Sabah state government should repeal the 13 new state seats gazetted in 2016, said Parti Warisan Sabah president Datuk Seri Mohd Shafie Apdal (pic).
Mohd Shafie said it was unconstitutional for the Election Commission (EC) to hold polls for 60 seats as the state constitution now requires polls to be held for 73 seats.
He added that Prime Minister Datuk Seri Najib Tun Razak is duty-bound to table the matter in Parliament as he does not have the power to repeal a state enactment or constitutional provision.
However, if Parliament does not table the new Sabah seats, Mohd Shafie said that the state would have to repeal its amendments (that had created those seats).
"No Prime Minister can repeal the amendments, it should be done in the State Assembly. Not even Chief Minister Tan Sri Musa Aman can repeal the Act without the endorsement of the assembly," he said.
Mohd Shafie said the amendments were passed by the State Assembly and should be honoured by the State and Federal Government.
"Don't backtrack and try to de-legitimise our victory if Warisan ends up winning," he quipped.
He spoke to reporters after a Warisan luncheon with local media here on Tuesday (April 3).
On Monday (April 2), the Gabungan Sabah coalition sought a court order compelling Najib to table the EC report on the 13 state seats in time for the 14th General Election.
The coalition, which consists of Sabah Progressive Party (SAPP), Sabah STAR, Parti Perpaduan Rakyat Sabah and Parti Harapan Sabah, filed a summons in the High Court on Monday naming Najib and the EC as defendants.
