Man escapes gallows following acquittal over drug trafficking charges

ALOR STAR: A 45-year-old unemployed man escaped the gallows after he was acquitted of drug trafficking charges at the High Court here.

Noor Zaidi was charged with committing the offences at the Dayang Bay Serviced Apartment Resort at Persiaran Pelangi in Kuah, Langkawi at about 4pm on June 24, 2014.

He was charged with trafficking 41.3g of heroin and 4.2g of monoacetylmorphines, an offence under Section 39B(1)(a) of the Dangerous Drugs Act, which carries the mandatory death sentence if found guilty.

For the second charge, Noor Zaidi was charged with possessing of 41.38g of methamphetamines at the same location and time, an offence under Section 12(2) of the same Act.

Judicial Commissioner Abu Bakar Katar said that the prosecution had failed to prove a prima facie case against the accused.

"The prosecution failed to prove that the drugs were under the care and control of the accused. The court also takes into consideration that the room was registered under the name of Nurul Adhani Abd. Razat,” he said. 

He acquitted Noor Zaidi of the two charges without calling for his defence.
