Court: Dayaks can’t claim communal land and forests next to their farms


KUCHING: In a decision that comes as a huge blow to the natives, the Federal Court has ruled that Dayaks cannot claim land and forests next to their cultivated farmlands as their own.

In a majority judgment, three senior judges made the landmark ruling saying that there was no law in Sarawak that allows customary rights claims by the Dayaks over forest reserves (pulau galau) and communal land or territorial domain (pemakai menoa).
