Award in Kugan’s case wrong, court hears

PUTRAJAYA: The landmark award of RM300,000 in exemplary damages to the family of A. Kugan, who died in police custody seven years ago, was wrong as it goes against the Civil Law Act, a Federal Court heard.

Senior Federal Counsel Alice Loke Yee Ching argued that Section 8(2) of the Civil Law Act was very clear in prohibiting the award of exemplary damages in such claim by the family of the deceased.
