Both Zizan and ex-manager’s suits thrown out

KUALA LUMPUR: Comedian Zizan Razak, who starred in the mega hit Polis Evo, lost a counter claim against his former personal manager whom he accused of damaging his reputation.

Likewise, his former personal manager Marina Juki also failed in her breach of contract suit against him.

Sessions Court judge Rosbiahanin Arifin dismissed both lawsuits with costs yesterday.

In her judgment, Rosbiahanin said she could not find any abuse of court process as claimed by the 31-year-old celebrity against his former manager.

On the breach of contract suit, the judge said that the agreement had stated it was between the company Wire Fame Entertainment Sdn Bhd and Zizan whose real name is Mohd Razizan Ab Razak.

“All the terms and conditions are between Wire Fame Entertainment and the defendant (Zizan).”

“It is impossible to be a basis for the plaintiff (Marina) as an individual to file a claim against the defendant,” said Rosbiahanin.

In the civil claim filed on Nov 5, 2014, Marina sued Zizan, claiming that he had signed a deal with her and Wire Fame Entertainment to appoint her as his personal manager.

Marina said the agreement was valid for four years from the date it was signed by both parties on May 3, 2011.

However, Marina claimed that Astro had confirmed in May 2014 that Zizan was under its management, thus the RM2mil contract was done without her or Wire Fame’s consent.

She claimed that Zizan had breached the contract signed with her and Wire Fame Entertainment and that she had 15% rights to the total income of the defendant.

Among others, Marina sought for RM535,500 in special damages and general damages to be assessed by the court.

In the counter claim filed on June 9 last year, Zizan said Marina had publicised the contents of her lawsuit against him before a copy was provided to him.

He said the publication of the allegations amounted to a misuse and abuse of court process.

The civil action, he claimed, was done with the aim of having a collateral advantage and ulterior purpose not countenanced by law.

Besides that, Zizan said Marina’s action was meant to damage his reputation.

He had sought general and aggravated damages for abuse of court process and malicious prosecution.

Zizan had won numerous awards including the “Most Popular Male Comedian” in the Anugerah Bintang Popular Berita Harian 2010 and 2012 as well as its Most Popular Male Host category in 2011.

He had also acted in movies like KL Gangster and Cicakman 3.
