NFCorp boss loses defamation suit against Nurul Izzah

KUALA LUMPUR: National Feedlot Corporation Sdn Bhd (NFCorp) executive chairman Datuk Seri Dr Mohamad Salleh Ismail (pic) has lost his defamation suit against Nurul Izzah Anwar over the purchase of eight properties at KL Eco City.

High Court judge Justice Hue Siew Kheng on Friday dismissed the suit with costs.

Justice Hue held that the Lembah Pantai MP had not defamed the plaintiff, had no malice and was justified in making her statement.

“The law requires the whole statement to be considered and to be read as a whole.

“I agree with the defendant that the statement read as a whole is not defamatory of the plaintiff as the press statement was made by the defendant in her capacity and position as MP for Lembah Pantai and the statement was directed at Datuk Seri Shahrizat Abdul Jalil as the former MP for Lembah Pantai,” she said in her judgment.

In his suit filed in December 2013, Dr Mohamad Salleh and NFCorp named Nurul Izzah and Saifuddin Nasution, the then secretary-general of PKR, as defendants for allegedly implying that he was greedy and had used his wife’s position to gain wealth.

Justice Hue said a “reasonable man when reading the statement as a whole would consider the article to be a call to accountability to Shahrizat in light of then PKR strategic director Rafizi Ramli’s statement and that it was not libel of the plaintiffs.

“Even if the statement was defamatory, the defence of justification applies as the statement was made without malice and the substance of the alleged defamatory statement has been justified as the truth of the material allegation has been established,” she said.

The judge dismissed the suit with RM80,000 in costs.
