High Court grants LBCN Development compensation over land conversion

SHAH ALAM: A land owner succeeded in getting a court order against the Kuala Selangor land administrator over compensation for the acquisition of their land in Ijok.

High Court judge Justice Vernon Ong Lam Kiat ruled that the land has to be valued meant for integrated development.

"The land is to be valued by taking into consideration all development and infrastructure works which had taken place there to determine the amount of compensation payable for the acquisition of their land," he said in his judgment.


The land owner - LBCN Development Sdn Bhd - has refered the dispute to the High Court following dissatisfaction that their eights lots of land in Ijok approved for integrated development has been changed to agriculture.

The owner said that the process was done without their knowledge and that of chargee banks and some of it had taken place a few days before the land acquisition proceedings.

Speaking to reporters later, their lead counsel B.Thangaraj said  the compensation payable for the eight lots of land would be based on commercial value and for all the infrastructures estimated to be RM1bil.

The land owner had claimed that the Selangor Registrar of Titles had fraudulently altered the category of land to suppress the value in order for them to receive a lower compensation for their acquisition.

Co-counsel Azad Bashir said that LBCN Development has urged the court to make a ruling on the status of their land in their favour as that the land was alienated for the purpose of integrated development.

Azad said that they have argued for the land to be valued for development for the purpose of assessment of compensation in a land reference proceedings.

In the court documents, the land owner said they had applied for the procurement of 1,372 acres of land in an area known as Revolusi Hijau Bukit Cherakah in Ijok for purposes of integrated development.

The owner said the land administrator in a letter dated Oct 19, 1999 had informed them that the state authority had agreed to their application.

The owner said that LBCN Development had been issued with document of titles pertaining to the said land and that the Kuala Selangor district council had on June 21, 2007 gazetted the local plan which showed the category of land use for integrated development.
