ROS to decide on Seniman AGM by Tuesday


KUALA LUMPUR: The Registrar of Societies (ROS) has to decide by Tuesday on a court order directing it to organise an annual general meeting (AGM) for Persatuan Seniman Malaysia to appoint new office bearers.

The order came following ROS’ claim that it was not responsible for organising an AGM for the association, said Seniman's lawyer, Mohd Faizi Che Abu.

He said that ROS has to make a decision by Tuesday as the High Court had directed it to organise an AGM for the association within two months of its order, dated Nov 21 last year.

“ROS has to organise an AGM for Persatuan Seniman Malaysia to appoint new office bearers. The association needs a quorum to hold the AGM.

“This is due to the court ruling that all members registered after
April 28, 2010 be struck off the association's registry," he told reporters after the parties met High Court Judicial Commissioner Rosilah Yop in chambers Monday.

Mohd Faizi said that ROS’ federal counsel Salwa Mohd Ashraf wanted to get further instructions from her office over the matter as the order's final day is today.

“We have sent a letter dated Dec 2 last year to ROS to take further action but so far, nothing has been done," he added.

He said the judge has informed ROS that it could only appeal the decision or file the proper application to vary the order.

Five artists, mostly veterans, succeeded in their bid last year to get a court order to declare the association’s 14th AGM invalid. 

The five are also members of the association.  

Among the veteran artists are actors Abu Bakar Omar, 64, and Sahlan Sudiran, 71.

The artists have named the association and its president Haron Aminar Rashid Salim, secretary Omar Kamarudin and treasurer Wafa A. Kadir for the 2009/2012 session among the eight defendants.

In the original claim filed on Jan 25 last year, 10 artists filed a
suit against the defendants. Later, five names were withdrawn. 

Among those who withdrew were C.L Yahaya Loong, 84, 
who had passed away in February last year, and Sharifah Haminah Abdullah, 67.

In their lawsuit, the artists claimed that the 14th AGM, which was held on May 26, 2012 at Dataran Karyawan Finas in Ampang was held by the defendants in an improper manner with the attendance of registered members and hundreds of “doubtful members”.
